The Louisiana Unfair Trade Practices Act
The Louisiana Unfair Trade Practices Act (LUTPA), La. R.S. 51:1401, et seq., is a powerful legal tool available for use by Louisiana consumers, competitive business owners, or any individual against businesses who attempt to take unfair advantage of them. Under LUPTA, Should any Louisiana business engage in conduct that intentionally deceives competitors or consumers, that business may be held financially liable for those unfair practices or acts.
The Louisiana Unfair Trade Practices Act specifically prohibits the following unfair business practices, among others:
- Misleading advertising
- Theft of trade secrets
- Deceptive pricing
- Breach of confidentiality
- Misuse of proprietary information
- Piracy of key employees
- Breaches of fiduciary duties by agents, officers, managers, or employees
