Breach of contract is the most common source of dispute in a business relationship. A breach occurs whenever a party fails to perform according to its obligations. Under Louisiana law, contracts can be anything from formal documents drafted by a lawyer and signed in presence of witnesses to a private handshake agreement. Certain transactions, however, require certain formalities in Louisiana, and we can advise you as to Louisiana’s legal system for contracts and obligations.
Under Louisiana law, fiduciary duties arise in almost all relationships of trust. Louisiana law on this subject is quite complex. The law regarding prescription of claims for breaches of fiduciary duty (the civil law equivalent of statutes of limitations) is particularly intricate, and we have experience not only in handling such claims on a routine basis, but also in the development of Louisiana law on this subject.
